Vic: Pair found guilty of manslaughter over stabbing
MELBOURNE, Dec 18 AAP - Two men have been found guilty of the manslaughter of a man
who was fatally stabbed and bashed with a baseball bat.
Tyrone David Shepherd, 36, of Glen Waverley, was outside his ex-girlfriend Sarah Kell's
house when he was attacked by her brother Simon Kell and Ms Kell's new boyfriend, Robin
Dey.
Kell, 27, and Dey, 25, both of Camberwell, had pleaded not guilty to Shepherd's murder.
On Thursday, a Victorian Supreme Court jury found both men guilty of manslaughter over
the incident at Ashwood in June, 2007.
The jury had heard Kell and Dey attacked Shepherd after he went to visit Ms Kell, wanting
to talk to her.
At the time, a court order was in place preventing him from contacting her.
When Ms Kell told her brother that Shepherd was there, Kell and Dey drove to her house
armed with a knife and baseball bat, prosecutors alleged.
The court heard Mr Shepherd, a heroin addict, had been violent toward Ms Kell before,
once breaking her nose.
Both men said it was the other who produced the knife.
Kell's lawyer Tom Danos said he acted out of concern for his sister and believed she
was in danger.
Justice Lex Lasry ordered the men return to court in January for a pre-sentence hearing.
